Federal judge allows lawsuit against NSA - Boston.com

It has been firmly established that the National Security Agency (NSA), after 9/11, engaged in wiretapping of Americans. The NSA did not obtain a warrant from any judicial body that would allow them to legally wiretap Americans. There was no judicial oversight at anytime during the wiretapping. In addition, the NSA demanded telephone records from BellSouth, AT&T and Verizon. The Bush administration argues that the NSA was exempt from obtaining a warrant because doing so would reveal state secrets and compromise national security. The question is "who then decides when an action will would reveal state secrets and/or compromise national security?" The same people who are doing the wiretapping. What ever happened to the balance of power?
